1. Agreement
These Terms of Use (“Terms”) govern your access to and use of applicationgenie.com (the “Service”), operated by HandsomeDog Studio (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
The Service helps you manage job search–related information, including (as applicable) criteria, opportunities, documents (such as resumes and cover letters), and integrations with third-party data or tools. Features may change over time. We may add, modify, or remove functionality without notice unless we are required to notify you under applicable law.
3. Eligibility and accounts
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@applicationgenie.com if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Violate any law or third-party rights.
- Attempt to gain unauthorized access to the Service, other users’ data, or our systems.
- Use the Service to transmit malware, spam, or harmful content.
- Scrape, overload, or interfere with the Service or its infrastructure except through interfaces we intentionally provide.
- Misrepresent your identity, qualifications, or affiliations in materials you create or submit through the Service.
We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or others.
5. Your content
You retain ownership of content you upload or create through the Service (“Your Content”), subject to the license below. You represent that you have the rights needed to provide Your Content and that it does not violate law or others’ rights.
To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit Your Content solely to provide, maintain, secure, and improve the Service for you, and as described in our [Privacy Policy link].
You are responsible for the accuracy and legality of Your Content (including resumes, cover letters, and profile information). We do not verify employment history, credentials, or third-party job postings.
6. Third-party services and job listings
The Service may rely on or link to third-party websites, APIs, or employers (“Third-Party Services”). Those services have their own terms and privacy practices. We do not control Third-Party Services and are not responsible for their availability, accuracy, or conduct.
Job postings and employer information may be incomplete, outdated, or incorrect. A listing in the Service does not imply endorsement by us or any guarantee that a role is still open. You apply to employers at your own risk and must comply with each employer’s application process and terms.
7. AI-assisted features
Where the Service uses automated or AI-assisted tools (for example, to help draft or tailor documents or populate profile fields), outputs may be inaccurate, incomplete, or unsuitable. You must review, edit, and approve any AI-generated or AI-assisted content before you rely on it or submit it to employers. You remain responsible for what you submit.
8. No employment or outcome guarantee
The Service is a tool to support your job search. We do not guarantee interviews, offers, or employment. We are not your employer and do not make hiring decisions for third parties.
9. Intellectual property
The Service, including its software, design, branding, and documentation (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights to use the Service as these Terms allow, we grant you no other rights.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, we (and our affiliates, directors, employees, and suppliers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim or (b) USD $100 / local equivalent. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
12. Indemnity
You will defend and indemnify us and our affiliates, officers, directors, employees, and agents against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.
13. Changes
We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if we must comply with law, or if we discontinue the Service (where permitted, with reasonable notice when practical).
Upon termination, provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnity, and governing law) will survive.
15. Governing law and disputes
These Terms are governed by the laws of Colorado, without regard to conflict-of-law principles.
